Proposed Resource Consent Conditions

16 Condition Explanation G37 All planting and offsetting work required to be undertaken under Condition G36 shall: a. Use plants which are ecosourced from the Coromandel or Bay of Plenty Ecological Region; and b. Use seed collected locally and germinated and raised at a New Zealand Plant Producers Incorporated (NZPPI)-accredited nursery or from a suitable alternative community-based nursery. G38 All planting required to be undertaken under Condition G36 shall be subject to annual maintenance, including regular releasing of plants from weeds and replacement of plants that do not survive. Any species that consistently fail shall be replaced with an alternative similar species listed as suitable for that purpose in the certified Riparian Vegetation Management Plan required by Condition G42. The maintenance period must commence following pioneer planting and may end when 70 percent stream canopy shade success is achieved, except where this planting is carried out adjacent to the Ruahorehore Stream and the Ohinemuri River, in which case success measures will be determined by a suitable ecological assessment of canopy health. Access and Protection G39 a. Stream diversions or stream loss authorised in Area 5, 6 and 7 must not commence until the Waikato Regional Council has been provided with written confirmation that the Consent Holder has entered into legal agreements and/or holds other authorisations necessary to allow entry onto land to carry out, continue and maintain all Aquatic Offset measures required by Condition G34 (d). b. The written confirmation provided under Clause (a) must describe the specific legal arrangements and the land to which they apply, being land purchase, agreement providing for covenanting or similar registered title instruments that have been entered into to provide the planted and retired areas to be retained in perpetuity. This condition recognises that the Aquatic Offset required for Areas 5, 6 and 7 requires access to land not owned or under the direct control of OGNZL. G40 The Consent Holder shall use its best endeavours to procure the entering into of appropriate covenants and/or encumbrances (or similar legal mechanism) to ensure that, regardless of any future ownership/tenure changes, the areas of land required for riparian planting specified in Condition G36 are protected in a manner that achieves at least the area of land retirement and revegetation planting specified in Condition G36 in perpetuity and shall upon request from the Waikato Regional Council report progress on these best endeavours.
