61 Condition Explanation The Consent Holder shall not take active steps for the sale of any of the land required for revegetation planting specified in Condition 171 until an appropriate covenant and/or encumbrance (or similar legal mechanism) is registered against each relevant title. Ecology and Landscape Management Plan 178 At least 30 working days prior to the commencement of activities under this consent the Consent Holder shall submit an Ecology and Landscape Management Plan to the Consent Authorities for certification that: a. It includes actions, methods, trigger levels and monitoring programmes designed to achieve the objectives in Condition 179 below; and b. As a minimum, it meets the information requirements in, and gives effect to, the matters set out in Conditions 180 – 188. 179 The objectives of the ELMP are to identify how the potential adverse effects of the Waihi North Project on the ecological, landscape and biodiversity values within the WNP Area and its surrounds will be avoided, remedied, mitigated and offset for, including on: a. vegetation and habitats; b. herpetofauna (lizards and frogs); c. bats; and d. avifauna. 180 The ELMP shall include: a. A summary of the ecological and landscape values within the area affected by the project and the potential effects of the project on those values; b. The access rights necessary to carry out the restoration and riparian planting, and to carry out the required pest management where these activities are to occur on land that is not owned by the Consent Holder; c. Maps showing the location and extent of the Planting Areas required by Condition 171; d. Details of monitoring and reporting to the Hauraki District Council prior to, during and post-construction and operation to determine if the ELMP objectives and the performance measures are being met; and e. Details of the roles and responsibilities of key staff responsible for implementing the ELMP and procedures for training of contractors and other Project staff regarding the ELMP.
