B-6 – Area 6 – Assessment of Environmental Effects 108 and velocity of flows. This channel will have greater resilience to erosion than is the case under the existing conditions of TB1;159 The effects of disturbing the bed of the channel are broadly considered in Section 7.6.1.2 with respect to water quality and flow regimes and Sections 5.6 and 7.5.1.4 with respect to aquatic ecosystems;160 As set out in Sections 7.4.1.4 and 7.5.1.4 of this statutory evaluation, fish passage will be provided (as appropriate) within the diversion channel, as will the replacement of fish habitat;161 The evaluation with respect to natural character in Section 7.5.1.5 confirms the natural character of TB1 (including the bed and margins of the tributary) are protected from inappropriate use and development;162 All instream structures have been appropriately sized to manage potential flood hazard effects, including the diversion channel and culverts (refer to Section 5.4 natural hazards of this AEE;163 OGNZL continues to work with tangata whenua regarding cultural effects and how the project can best accommodate and provide for their relationship with identified taonga. This is considered further in Section 5 of the Overarching AEE;164 While no legal public access mechanisms are formally proposed as part of the NRS works, access will still be available via the river, as discussed in Section 5.15 of this AEE;165 and The Instream Work Aquatic Ecology Management Plan will detail how instream works will be managed to avoid the introduction of pest and weed species.166 Overall, the proposed structures located within the bed and margins of the river banks (and the associated disturbances) are considered to be broadly consistent with the outcomes sought by Objectives 4.2.2 and 4.3.2 and the associated policies. 7.6.1.8 Accelerated Erosion A net reduction of accelerated erosion across the region is the key outcome sought by Objective 5.1.2, so that: 159 Objective 4.2.2(a) and 4.3.2(d), Section 4.2 and 4.3, Waikato Regional Plan. 160 Objective 4.2.2(b), Section 4.2, Waikato Regional Plan. 161 Objectives 4.2.2(c) and 4.3.2(o), Section 4.2 and 4.3, Waikato Regional Plan. 162 Objectives 4.2.2(d) and 4.3.2(h), Section 4.2 and 4.3, Waikato Regional Plan. 163 Objectives 4.2.2(e) and 4.3.2(e), Section 4.2 and 4.3, Waikato Regional Plan. 164 Objectives 4.2.2(g) to (i) and 4.3.2(f) and (g), Section 4.2 and 4.3, Waikato Regional Plan. 165 Objectives 4.2.2(j) and 4.3.2(n), Section 4.2 and 4.3, Waikato Regional Plan. 166 Policy 8.3(e)(iii), Waikato Regional Policy Statement.
