B-5 – Area 5 - Assessment of Environmental Effects 183 recognising and providing for important mineral extraction activities, while avoiding, remedying or mitigating associated effects242 and ensuring such activities do not constrain established and lawful rural production activities;243 where practicable, avoiding, remedying or mitigating adverse effects on the environment and amenity of the district (including noise, smell, glare, vibration and visual);244 and where necessary, avoid development in areas likely to be adversely affected by natural hazards, in preference to mitigating adverse hazard effects.245 When evaluating the above provisions, of particular note with respect to the activities occurring within Area 5 are the following: the policy framework for the Rural zone anticipates mineral extraction and associated activities (such as tailings storage), subject to appropriate management of effects;246 the activities associated with Area 5 are compatible with established and lawful rural production activities and will not give rise to reverse sensitivity effects;247 Area 5 will generally be reverted to pasture post closure of the GOP TSF tailings storage facility. As set out in Section 7.6.1.11 of this Statutory Evaluation, it is anticipated that this area will be suitable for future pastoral purposes;248 the activities proposed within Area 5 are considered appropriate within the surrounding modified rural environment which includes existing mining activities. In this context, the amenity values of the existing modified rural character (including mining) are maintained;249 and the amenity values of the Waihi area and wider community are discussed with respect to noise, landscape values, air quality, lighting and vibration in Sections 5 of this AEE. The mitigation measures described with respect to each of these matters are designed to ensure the adverse effects on amenity values are appropriately avoided, remedied or mitigated.250 Overall, the activities proposed within Area 5 will not restrict or prevent the range of rural land use activities to be undertaken surrounding the site.
