B-5 – Area 5 - Assessment of Environmental Effects 169 Accordingly, the management of discharges to water will achieve the outcomes sought by Objective 3.5.2. The management of non-point discharges is guided by the policies in Section 3.9 of the WRP. Of particular relevance is Policy 1, which seeks to reduce the adverse effects of nonpoint source discharge arising from land uses and activities by minimising the leaching and run-off of contaminants and sediment into water, avoiding bed and bank erosion and instability and recognising and avoiding the effects of non-point discharges on the relationship tangata whenua as kaitiaki have with water. The policy also seeks to avoid, remedy or mitigate adverse effects on rivers and their margins to maintain and enhance natural character. Of particular note: as described in Section 5.11.2 of this AEE and Sections 3.7.1 and 7.1 of GHD (2022b), seepage from the GOP TSF will be intercepted and pumped to the WTP for treatment prior to discharge into the Ohinemuri River. This will minimise the potential for the seepage of contaminants into groundwater water;150 non-point discharges include diffuse discharges into groundwater from beneath the TSF. As these will not occur directly into the stream bed or banks, no bed or bank erosion or natural character effects will arise;151 and OGNZL continues to work with tangata whenua regarding cultural effects and how the project can best accommodate and provide for their relationship with identified taonga. This is considered further in Section 5 of the Overarching AEE.152 Accordingly, non-point discharges associated with activities within Area 5 will achieve the directives set out in Policy 1, Section 3.9. 7.6.1.5 Damming / Diverting The outcomes sought for the damming and diverting of water are described in Objective 3.6.2 and associated Policy 2. These provisions collectively seek that damming and diversion: does not generate adverse effects that are inconsistent with the water management objectives in Section 3.1.2 or associated surface water policies in Section 3.2.3;153 150 Policy 1(a), Section 3.9, Waikato Regional Plan. 151 Policy 1(b) and (d), Section 3.9, Waikato Regional Plan. 152 Policy 1(c), Section 3.9, Waikato Regional Plan. 153 Objective 3.6.2(a) and Policy 1(a), Section 3.6, Waikato Regional Plan.
