Refer Section 2 of this AEE. Alternative options for the disposal of overburden have been considered by EGL(2022a). Overall, however, it is normal practice to backfill voids created by underground mining. Spoil management measures will be put in place to reduce the potential effects of such activities on water quality. Discharge of contaminants to air. Refer to Section 2 of this AEE. The proposed discharge of contaminants to air are being undertaken in accordance with best practice and will not result in the degradation or air quality within CFP. The recommended methods are therefore the most appropriate in the context of the receiving environment and the nature of the discharges. 7.10 SECTION 107 OF THE RESOURCE MANAGEMENT ACT 1991 Sections 107(1)(a) and (b) of the RMA specify that the consent authority shall not grant a discharge permit allowing the discharge of water / contaminant into water or land if, after reasonable mixing, the contaminant or water discharged (either by itself or in combination with the same, similar, or other contaminants or water) is likely to give rise to all or any of the following effects in the receiving waters: the production of any conspicuous oil or grease films, scums or foams, or floatable or suspended materials; any conspicuous change in the colour or visual clarity; any emission of objectionable odour; the rendering of fresh water unsuitable for consumption by farm animals; and any significant adverse effects on aquatic life. Based on the assessment in Section 5 and the mitigation proposed in Section 6 of this AEE, the discharge of water / contaminants to water or to land in circumstances where it may reach water will not give rise to any of the effects listed above after reasonable mixing.
