B-7 – Area 7 - Assessment of Environmental Effects 137 A range of management plans will also be prepared and implemented by suitably qualified and experienced ecologists to manage effects on ecological values, including avifauna, lizards, bats, fish and koura. With respect to geotechnical matters, natural hazards and impacts on ground and surface water, TSF3 has been designed and will be constructed and operated in a manner consistent with that which currently occurs at OGNZL’s existing facilities, and which has been demonstrated to have been successful for managing and monitoring potential effects. This includes a range of design elements to encapsulate and / or neutralise PAF material, and to contain, collect and treat seepage and runoff from PAF rock and tailings. Further peer review of the detailed design is required by an appropriately qualified independent party as is a building consent. No additional mitigation measures are expected to be required. However, a TSF3 Monitoring and Management Plan will be prepared and implemented to monitor the effects of the TSF3 on the land, ground and groundwater resources and to trigger the implementation of contingency measures where necessary. With respect to the statutory planning framework that applies to the activities at Area 7, it is concluded that the development of the project in the manner proposed by OGNZL will for the most part align comfortably with the overall management intentions specified in the relevant national, regional and district planning documents based on the effects assessments included in these application documents. Many of these statutory planning documents recognise the importance of the mining sector and the need to provide for its continuation (subject to the management of potential effects on the environment). It certainly cannot be concluded that the activities at Area 7 will be contrary, or repugnant, to any of the relevant statutory planning documents. This assessment will be updated following receipt of the various CVA / CIA documents being produced by tangata whenua. Finally, it is noted that OGNZL has consulted with interested / potentially affected parties and the wider community with respect to the WNP and activities in Area 7. This consultation has informed the various environmental assessments and will continue throughout the resource consent process and during the subsequent operation of the WNP.
