B-7 – Area 7 - Assessment of Environmental Effects 130 7.6.2.4 Riparian Margins and Esplanade Reserves Objectives 1 and 2 of Section 7.3 of the HDP relate to the management of public access to waterbodies, and seek the following outcomes: sustainably manage the margins of waterbodies to maintain or enhance natural character, indigenous biodiversity, water quality, and aquatic and adjoining terrestrial habitats;208 and the maintenance and enhancement of public access to the margins of waterbodies in a manner that is compatible with the preservation of conservation values and does not unreasonably interfere with the landowner’s ability to use and enjoy the land.209 The associated policies focus on the use of the legislative mechanisms in the RMA to secure esplanade reserves and strips on subdivisions,210 and the HDC negotiating to either have the land vested or set aside on a voluntary basis.211 While the project will result in the damming and diversion of a tributary of the Ruahorehore Stream, an extensive biodiversity offsetting programme is proposed to ensure a net environmental gain with respect to the values of the modified watercourse that will replace the tributary. With respect to riparian planting, this includes (but is not limited to) riparian planting at least 10 m wide on either side of the modified watercourse and the Ruahorehore Stream. This planting is expected to contribute towards enhancement of the natural character, indigenous biodiversity, water quality and aquatic and adjoining terrestrial habitats. There are no public recreation opportunities in the development area as the land is in private ownership. The evaluation in Section 5.13 of this AEE concludes that there are no adverse effects on recreation or tourism as a result of the development and operation of TSF3. 7.6.2.5 Hazardous Substances and Contaminated Land Section 7.7 of the HDP relates to the management of hazardous substances and contaminated land.
